NE Supreme Court rules in favor of pipeline ban

March 26, 2013 – The Nebraska Supreme Court has affirmed a lower court’s ruling that confirmed a state township’s right to regulate manure pipelines on its right of way.

The owner of Tuls Dairy wanted to run a pipeline under a county road just north of the dairy’s manure lagoon. The township enacted the ordinance to ban underground pipelines carrying liquid manure under its roads. READ MORE
