EPA’s Halloween surprise, another comment period

November 7, 2012 – On October 31, 2012, the EPA announced another round of comments on the Clean Water Act regulation for Concentrated Animal Feeding Operations (CAFOs). This time, the EPA has issued a notice that it is reviewing, under Section 610 of the Regulatory Flexibility Act, the Clean Water Act CAFO regulation as issued in 2003.

The Regulatory Flexibility Act requires that a federal agency review the impacts of a regulation on “small entities” within 10 years of the regulation’s promulgation. READ MORE
