EPA unveils guidance on Clean Water Act

April 29, 2011 – The
Environmental Protection Agency issued guidance on April 27 that lays out the
agency’s determination of what waters of the United States fall under the
protection of the Clean Water Act.

Environmental Protection Agency issued guidance on April 27 that lays out the
agency’s determination of what waters of the United States fall under the
protection of the Clean Water Act.

The new guidance, which
will proceed to formal rulemaking at the conclusion of a 60-day public comment
period, was developed by the EPA in conjunction with the U.S. Army Corps of
Engineers
. The guidance addresses key criteria for determining if headwaters,
including “perennial, intermittent, and ephemeral streams,” are subject to
regulation under the intent of the Clean Water Act.
