Court upholds revocation of dairy permit

MN – In a new review, a Minnesota appeals court found in favor of the Minnesota
Pollution Control Agency’s revocation, then re-issue, last year of a Thief
River Falls dairy’s permit.

In a recent decision, the
Minnesota Court of Appeals said the MPCA properly revoked, then reissued Excel
Dairy’s permit, but that the agency “abused its discretion,” in denying Excel a
reconsideration of the MPCA’s action last summer.
